These Terms govern your use of any services we offer directly or through our digital platforms.
2. Use of the Website and Services
You may only use our services for lawful purposes and in line with these Terms. You agree not to:
Violate any Dutch or EU laws or regulations
Interfere with or disrupt our platforms or infrastructure
Attempt unauthorized access to accounts, systems, or data
Upload or distribute malicious content or spam
Misrepresent your identity or affiliation
We reserve the right to deny or restrict access to users who violate our policies or misuse our services.
3. Registration and Access
Certain features may require you to create an account. When registering, you must provide accurate and up-to-date information. You are responsible for safeguarding your login credentials and for all activity under your account.
If you believe your account has been compromised, please contact us immediately.
4. Client Platforms and Dashboards
If you are a client, you may be granted access to custom dashboards or client portals. This access is intended exclusively for your internal use and is subject to your commercial agreement with Zizia.
Sharing access credentials, reselling services, or repurposing our dashboards without permission is strictly prohibited.
5. Intellectual Property Rights
All content, software, visualizations, dashboards, and branding on or from Zizia are protected under copyright and intellectual property laws in the Netherlands and internationally.
You may not reproduce, distribute, modify, or commercially exploit our content without prior written consent, unless explicitly allowed in your agreement with us.
Custom dashboards and deliverables may remain the intellectual property of Zizia unless otherwise contractually agreed.
6. Third-Party Services
Zizia’s services may integrate with third-party tools (e.g., Power BI, Google Analytics). We are not responsible for their content, accuracy, or policies.
You are also bound by the terms of those services where applicable.
7. Privacy and Data Processing
We handle personal data in compliance with the General Data Protection Regulation (GDPR), known in the Netherlands as the AVG (Algemene Verordening Gegevensbescherming).

By using our services, you agree to our handling of personal data in accordance with applicable Dutch and EU laws.
8. Confidentiality
Both parties agree to treat any non-public information exchanged through our services or collaboration as confidential. This includes business data, analytics, system designs, and client-specific implementations.
Confidentiality survives termination of service.
9. Availability and Maintenance
We strive to offer consistent and reliable access to our services. However, we do not guarantee uninterrupted operation. Scheduled maintenance or unforeseen technical issues may temporarily impact availability.
We are not liable for disruptions outside our control, such as hosting outages or third-party service failures.
10. Fees and Payment (if applicable)
If you engage Zizia under a paid service agreement, fees, billing cycles, and terms of payment are set out in your individual contract.
Late or failed payments may result in restricted access or service suspension. All stated prices are exclusive of VAT, unless explicitly mentioned otherwise.
11. Termination of Use
We may suspend or terminate your access to our services if you:

Fail to meet payment obligations
Misuse or compromise the integrity of our platform
You may also discontinue use of the platform or request account deletion at any time. Termination does not affect any rights or obligations accrued prior to termination.
12. Limitation of Liability
Zizia is not liable for indirect, incidental, or consequential damages arising from your use of our services. We deliver our tools and insights in good faith, but decisions based on data remain the user’s responsibility.
To the extent permitted by Dutch law, our total liability is limited to the amount paid for services in the six (6) months prior to the event giving rise to the claim.
13. Changes to These Terms
We reserve the right to amend these Terms as our services evolve or legal requirements change. Updates will be posted on our website with an effective date.
By continuing to use our services after changes are published, you agree to the updated terms.
14. Governing Law and Dispute Resolution
These Terms are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam, the Netherlands, unless another venue is specified in a separate written agreement.
